I wish to inform the Deputy that the information provided in tabular form below relates to European Arrest Warrants received under the European Arrest Warrant Act 2003 as amended and requests received under Part II and Part III of the Extradition Act 1965 as amended. The European Arrest Warrant Act 2003 as amended repealed Part III of the Extradition Act 1965 as amended. As a consequence surrender procedures between Ireland and England and Wales, Northern Ireland and Scotland are now governed by the provisions contained in the European Arrest Warrant Act 2003 as amended and extradition arrangements with the Isle of Man and the Channel Islands now come within Part II of the Extradition Act 1965 as amended. With effect from 1 January 2004 no new requests under Part III of the 1965 Act can be made.

The following table reflects the number of incoming requests received under Part III in 2003 and the "refused" and "extradited" columns relate to the year of the decision and not the year of the receipt of the request. In relation to requests under Part II of the Extradition Act 1965 as amended the information provided in the "refused/withdrawn etc" and "extradited" columns refers to the present position of the requests. In relation to European Arrest Warrants (EAWs), the information provided in the "surrendered" and "refused" columns relates to the year of the decision and not the year of the receipt of the EAW.

I wish to inform the Deputy that the information provided in tabular form below relates to European Arrest Warrants forwarded under the European Arrest Warrant Act 2003 as amended and requests forwarded under Part II of the Extradition Act 1965 as amended.

Prior to the enactment of the European Arrest Warrant Act 2003 as amended, extradition between Ireland and England and Wales, Scotland and Northern Ireland was governed by Part III of the Extradition Act 1965 as amended. Under Part III of the 1965 Act, outgoing requests were forwarded by the Garda Síochána and the Minister for Justice, Equality and Law Reform or the Department did not have a role in this procedure. The information regarding outgoing Part III requests to the U.K. is not readily available and I will revert to the Deputy when this information becomes available.

In relation to European Arrest Warrants (EAWs) the information provided in the "surrendered" and "refused" columns relates to the year of the decision and not the year of the transmission of the EAW. In relation to requests forwarded under Part II of the 1965 Act the information provided in the "extradited" and the "refused/withdrawn etc" columns relates to the current position of the outgoing requests.
