To ask the Minister for Transport, Tourism and Sport in light of the recent High Court case regarding CIE pensions, where the High Court put an obligation on both CIÉ and the active members to ensure that the scheme is fully funded on an ongoing basis to comply with sections 44(1) and (2) of the Pension Act 1990 meaning CIÉ has an obligation to comply with these sections of the act today, did CIÉ have the same obligations to comply with these sections of the Pension Act 1990 in 2009, and again in 2013; and if he will make a statement on the matter. From the outset I would like to clarify that I, as Minister for Transport, have responsibility for policy and overall funding in relation to public transport. However, issues in relation to Córas Iompair Éireann (CIÉ) pension schemes are primarily a matter for the trustees of the pension schemes, the CIÉ Group and their employees.
Therefore, I have referred the Deputy's question to CIÉ for direct reply. Please advise my private office if you do not receive a response within ten working days.
