1114. To ask the Tánaiste and Minister for Justice and Equality his plans to introduce pre-action protocols and other tort reforms in order to reduce the time and financial cost of dealing with medical and clinical negligence claims; and if he will make a statement on the matter. [11179/25]

Following consultation with stakeholders, drafting of the Civil Liability and Courts Act 2004 (Clinical Negligence) Pre-Action Protocol Regulations is ongoing.

These regulations will introduce a protocol in relation to proceedings concerning possible clinical negligence. The aims of the protocol are to encourage early resolution of allegations of clinical negligence, promote timely communication between the parties, reduce the number of cases which go to court, facilitate the early identification of issues in dispute and encourage the early settlement of such cases.

Work is also ongoing on the preparation of a General Scheme of a Civil Reform Bill to advance other recommendations made by the Review of the Administration of Civil Justice (Kelly Report) which I hope to publish later this year.
