763. To ask the Minister for Employment Affairs and Social Protection to examine the case of back payments to a person (details supplied); and if he will make a statement on the matter. [3516/25]

The Social Welfare Appeals Office is an Office of the Department of Social Protection which is responsible for determining appeals against decisions in relation to social welfare entitlements. Appeals Officers are independent in their decision making functions.

The Appeals Officer assigned to the appeal of the person concerned decided on the question of entitlement. There was no question before them as to the date of entitlement. A review under section 317 was allowed subject to all other conditions for the scheme being met.

The Appeals office will take the Deputies query as an appeal on the backdating and will process it.

I trust this clarifies the matter for the Deputy.
