To ask the Minister for Enterprise, Trade and Employment to outline the protection provided to former employees of a company (details supplied) under the Protection of Employees (Employers’ Insolvency) Act 1984 (as amended) following its insolvency in 2009; this, as it relates to pension payments; and if he will make a statement on the matter. I propose to take Questions Nos. 324 and 344 together.

The Insolvency Payments Scheme operates under the Protection of Employees (Employers’ Insolvency) Act 1984. The purpose of the scheme is to protect certain outstanding pay-related entitlements due to employees in the event of the insolvency of their employer. Payments are made from the Social Insurance Fund.

Section 7 of the 1984 Act allows applications to the Insolvency Payments Scheme where an employer has become insolvent and has failed to pay certain employee and employer pension contributions.

The application for unpaid pension contributions by the company in question is the subject of an adjudication case in the Workplace Relations Commission (WRC). The adjudication is awaited.

The WRC is an independent statutory body and I cannot comment on individual cases.
