To ask the Minister for Transport, Tourism and Sport if his attention has been drawn to any issue preventing an Irish citizen holding an Irish road transport management CPC and resident in Northern Ireland from being nominated as a transport manager on Irish road transport operator licences in companies within the State; and if he will make a statement on the matter. Regulation (EC) No 1071/2009 governs admission to the occupation of road transport operator and includes requirements relating to the transport manager. Persons wishing to act as transport manager for a road transport operator established in an EU Member State, including in Ireland, must hold a Transport Manager Certificate of Professional Competence issued in an EU Member State, and they must, as set out in this EU Regulation, be resident in the EU. Residence in the United Kingdom, including Northern Ireland, does not satisfy this requirement, and while Ireland raised this important matter with the European Commission in advance of Brexit given our unique circumstances, the EU-UK Trade and Cooperation Agreement does not change this and Ireland does not have discretion to derogate from the legislative provisions as set out in Regulation (EC) No 1071/2009.
