Disadvantaged Areas Scheme Appeals

351. To ask the Minister for Agriculture, Food and the Marine if a decision has been made on the review of further medical evidence sent in support of an application for derogation of the stocking rate on a 2012 disadvantage area scheme application in respect of a person (details supplied) in County Kerry; and if he will make a statement on the matter. An application was received from the person named under the 2012 Disadvantaged Areas Scheme. During processing it was found that the Scheme minimum stocking density requirements had not been satisfied.
The person named was notified of this on 1 March 2013 and given the opportunity to appeal the decision. The person named has appealed this decision and my department is currently awaiting the submission of additional evidence supporting this appeal. The application of the person named will be further reviewed on receipt of this information and the person named will be notified of the outcome directly.

The person named is one of a number of 2013 Disadvantaged Areas Scheme applicants, whose cases were impacted by the requirement to have achieved a minimum stocking density of 0.3 livestock units per forage hectare in 2011. The person named applied for but was refused derogation in this regard. The person named subsequently appealed unsuccessfully to the independently chaired DAS Appeals Committee.
The person named subsequently availed of their right to pursue the matter with the Office of the Ombudsman and the case is currently under consideration by that Office.
