Question 259: To ask the Minister for Justice and Equality if he will explain the way Section 3(9) of the Firearms Act allows a firearms licence holder to apply for renewal of their firearms certificate three months before expiry of the existing certificate whereas Section 9(6)(C) of the same act only allows for the same application to be made one month before expiry and if he will confirm which provision is the correct one; and if he will make a statement on the matter. I can inform the Deputy that section 37 of the Criminal Justice (Miscellaneous Provisions) Act 2009 amended section 9(6) of the Firearms Act 1964 to provide for the deletion of the reference to a one month period for the application for renewal of a firearm certificate before the expiry of the certificate. Accordingly, section 3(9) of the Firearms Act 1925, as amended, which provides that a decision on an application for a firearm certificate or its renewal shall be given within 3 months from the date on which the applicant submitted a completed application form, is the relevant provision.
