Question 304: To ask the Minister for Social Protection the reason an award arising agreed via employment appeals tribunal has not being paid in the case of a person (details supplied) in County Offaly; if any outstanding entitlement to State redundancies exist and is likely to be paid; the extent of redress available to them arising from their previous employers non-compliance with the decision of the EAT; and if she will make a statement on the matter. Claims made under the Insolvency Payments Scheme can only be processed if an employer is legally insolvent within the definition of the Protection of Employees (Employers' Insolvency) Act 1984. The employer in this case was not legally insolvent. No redundancy payment application has been received in respect of the individual concerned.
