Question 424: To ask the Minister for Agriculture, Food and the Marine when area aid will be paid to a person (details supplied) in County Laois; and if he will make a statement on the matter. [32199/11]

The herd number was in the joint names of the person named and his late brother. Payment arising from the 2010 Single Payment Scheme is due to the person named and to the estate of his late brother. No application under the Single Payment Scheme was received from the person named in 2011.

In March of this year the Inheritance Enquiry Unit of my Department wrote to the person named requesting the necessary documentation required to release the 2010 Single Payment namely a copy of a Grant of Probate or Letters of Administration as well as the details of the client account of the solicitor administering the estate of his deceased brother. The relevant documents have not yet been submitted.

The person named should engage with the Inheritance Enquiry Unit of my Department which will assist in bringing all outstanding matters to completion. That Unit can be contacted at:

Question 425: To ask the Minister for Agriculture, Food and the Marine the reason single farm payment has not yet been paid in respect of a person (details supplied) in County Kilkenny; and if he will make a statement on the matter. [32205/11]

An application under the Single Payment Scheme/Disadvantaged Areas Scheme was received from the person named on the 13th May 2011. This application was selected for and was the subject of a Ground Eligibility/Cross Compliance Inspection.

This inspection was completed and the results are now being processed.

In the vast majority of inspected cases amendments have had to be made to the maps in order that the Land Parcel Identification System that is used for making payments to farmers is kept up-to-date. Processing of these changes is continuing and priority is given to applications who were the subject of a Ground Eligibility Inspection.

Question 426: To ask the Minister for Agriculture, Food and the Marine when a decision will issue on an appeal in respect of persons (details supplied) in County Cork; and if he will make a statement on the matter. [32215/11]

An application under the Single Payment Scheme /Disadvantaged Areas Scheme was received from the person named on the 5th April 2010.

This application was selected for a ground eligibility/cross compliance inspection.

During the course of this inspection discrepancies were found that resulted in a claimed area of 23.28ha being reduced to 21.10ha. Under EU Regulations if the total area found is not sufficient to support the number of entitlements held, penalties will be applied per the Terms and Conditions of the scheme. In this case the number entitlements held by the person named is 23.53. As the difference between the area declared and the area found is more than 3%, under EU Regulations, the difference between the area found and the area claimed is doubled and deducted from the area found. As a result the area put forward for payment under the Single Payment Scheme was 16.74ha. The person named was informed of this decision on the 26th of August 2010 and of his right to seek a review. He was also informed of his right to appeal the outcome of any review to the Independent Agriculture Appeals office. To date, no request for a review has been submitted, however, your question will now be taken as a request for review which will now be carried out. As part of this review any new facts or evidence will have to be supplemented with supporting documentation.
