The person concerned has been furnished with a copy of their full social insurance contribution record. This is a full representation of customer social insurance contribution record as held by the Department. If the person concerned feels there are gaps or omission in his record he should contact the Departments Records section.

As advised in the response to PQ 26247/10, a claim in respect of Child Benefit was received from the person concerned in February 2009. Further information was requested in relation to this claim including the completion of a Habitual Residence questionnaire. This information has now been received and the claim has been disallowed as the person concerned is not considered to satisfy the Habitual Residence Condition. He has been notified of the decision in writing and advised of his right of appeal.

Question 228: To ask the Minister for Social Protection if he will indicate the entitlement of social welfare payment in the case of a person (details supplied); if steps will be taken to ensure that basic social welfare payment is restored; and if he will make a statement on the matter. The person concerned made his original application for Jobseeker's Allowance on 23/9/2009. He indicated that he arrived in Ireland on 27/6/2005. His application was disallowed by a Deciding Officer in October 2009 as he was not considered to be habitually resident within the state. A subsequent appeal was made by him and the decision of the Deciding Officer was upheld by an Appeals Officer in May 2010.

He had been in receipt of Supplementary Welfare Allowance and was paid to 23/6/10 while his appeal for Jobseeker's Allowance was pending. However as he was deemed not to be habitually resident within the state, this payment was terminated.

The Community Welfare Officer in the Health Service Executive advised the person concerned of this and granted him an additional three weeks payment on compassionate grounds. The Community Welfare Officer further advised him that the Community Welfare Service were not in a position to make any further payments to him as he was deemed not to be habitually resident within the state.

The person concerned does not have a work permit to engage in insurable employment and he cannot be treated as an EEA worker for the purpose of entitlement to Supplementary Welfare Allowance. He should contact the Department of Justice, Equality, and Law Reform in order that issues regarding his status can be resolved.

Question 229: To ask the Minister for Social Protection when supplementary rent allowance will be restored in the case of a person (details supplied) in County Kildare. [29051/10]

The Health Service Executive (HSE) has advised that rent supplement was refused on the 9th June 2010 as the person in question did not satisfy the habitual residency condition. If the person concerned is not satisfied with the decision of the Executive then they can appeal the decision to the HSE Appeals Office. The Executive further advised that no appeal has been received to date.
