The Social Welfare Appeals Office has advised me that, following receipt of the relevant Departmental papers including comments on the grounds of appeal, the appeal from the person concerned will be referred to an Appeals Officer for consideration.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

Question 461: To ask the Minister for Social Protection when an oral hearing will be scheduled to finalise a carer's allowance appeal in respect of a person (details supplied) in County Mayo. [28403/10]

The Social Welfare Appeals Office has advised me that the appeal from the person concerned has been referred to an Appeals Officer who proposes to hold an oral hearing in the case. The person concerned will be notified when the necessary arrangements have been made.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

Question 462: To ask the Minister for Social Protection when a carers allowance appeal will be reviewed and finalised by the social welfare appeals office in respect of a person (details supplied) in County Mayo. [28404/10]

I am advised by the Social Welfare Appeals Office that, an Appeals Officer, having considered all the available evidence, including that adduced at an oral hearing, disallowed the carer's allowance appeal of the person concerned. Following the submission of additional medical evidence the case was forwarded to the Chief Medical Adviser who advised that the medical evidence would not have impacted upon the findings of the Medical Assessor. The Appeals Officer accepts this opinion and his decision stands and the person concerned will be informed. A letter has been issued on 28/6/2010.

The Social Welfare Appeals Office has advised me that, following receipt of the relevant Departmental papers including comments on the grounds of appeal, the appeal from the person concerned was referred to an Appeals Officer for consideration. The Appeals Officer has referred the case to the Deciding Officer for clarification on certain matters. Every effort will be made to have this appeal dealt with as quickly as possible.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned was registered in that Office on 13 April 2010. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments on the grounds of appeal be sought. When received the appeal in question will be referred to an Appeals Officer for consideration.
