Question 136: To ask the Minister for Enterprise, Trade and Employment when former workers of a company (details supplied) in County Limerick who have yet to be awarded the Labour Court recommendations for an additional three weeks' redundancy pay despite the approval of the rights commissioner will be awarded their entitlement; and if he will make a statement on the matter. In November 2004 the Department of Enterprise, Trade and Employment announced a policy change to the Job Initiative Programme that provided for contracts to be renewed for participants who wished to remain on the scheme thus removing the requirement for participants to leave. This policy change brought about an amendment to the rules regarding redundancy payments and allowed for the payment of enhanced redundancy to persons made redundant after November 2004.

I understand that the matter in question relates to persons employed under a Job Initiative Scheme who were made redundant in November 2003, prior to the rule change, and therefore they would not have an entitlement to an enhanced redundancy payment.
