Question 224: To ask the Tánaiste and Minister for Enterprise, Trade and Employment the number of occasions on which her Department has sanctioned or applied for the payment of a pension top-up or discretionary payment on retirement to a staff member of the department or any agency under their remit in each of the past three years; the amount paid in each case; the position vacated; and if she will make a statement on the matter. In one case an application was made in 2007 for the payment of a severance gratuity in respect of a CEO whose contract was not being renewed. The proposed gratuity was not sanctioned by the Department of Finance and therefore was not paid.

In 2008 the Department of Finance sanctioned the following severance terms to the former Director General of FÁS under and in accordance with Section 6(3) of the Labour Services Act 1987:

Superannuation benefits (Pension and Lump Sum) based on 40 years service, including added notional service, payable with effect from 26 November 2008, and an ex-gratia payment, equivalent to 6 months salary, amounting to €111,243.50.

Three Civil Servants were dismissed from my Department in the last five years for misconduct, poor performance or failure to fulfil the terms of their contract. All three were dismissed during 2009.
