Question 271: To ask the Minister for Agriculture, Fisheries and Food the reason a person (details supplied) in County Galway has not received their single farm payment; if the entitlements have been transferred from another person to this person; and if she will make a statement on the matter. My Department has no record of receiving an application to transfer entitlements to the first person named for the 2007 Single Payment Scheme year. In order that a Single Payment may issue, a Transfer of Entitlement form together with the necessary legal documentation to facilitate a transfer by way of Inheritance from the second person named to the first person named must be submitted. However, while the extended closing date for receipt of applications to transfer entitlements was 8 June 2007, an official from my Department recently made direct contact with the first person named, outlining the position and it is understood that an application to transfer entitlements to the first person named in respect of the 2007 Single Payment Scheme will now be forwarded to my Department, together with a letter outlining the reasons for the late application. The application will be processed as soon as it is received.

An application under the 2007 Single Payment Scheme was received from the person named on 1 May 2007.

During processing of this application, it was found that a land parcel claimed by the person named was also the subject of a scheme application by another applicant. Following correspondence with both parties, it was confirmed by the person named that he was not entitled to claim this land, as it had been sold.

In accordance with the governing EU Regulations, a 100% penalty is applicable in such circumstances. As a result the person named is due no payment under the 2007 Single Payment Scheme.
