Question 337: To ask the Minister for Education and Science, further to Parliamentary Question No. 388 of 9 October 2007, in accordance with her constitutional and legal obligation under the Constitution of 1937, the reason for the failure of the State to explain why a person (details supplied) in Dublin 11 has not been in school for the past 12 months. The Education (Welfare) Act, 2000 established the National Educational Welfare Board (NEWB) as the single national body with responsibility for school attendance. The Act provides a comprehensive framework promoting regular school attendance and tackling the problems of absenteeism and early school leaving. The general functions of the Board are to ensure that each child attends a recognised school or otherwise receives a certain minimum education. Enrolment decisions are the responsibility of the Board of Management of each individual school. My Department has no role in relation to processing applications for enrolment by schools.

In relation to this particular case, the Board have been requested to provide an update to my Department on the child's education status. When this has been provided, I will be writing directly to the deputy with the relevant details.
