Question 167: To ask the Minister for Justice, Equality and Law Reform if a person (details supplied) in County Kildare who is now divorced can revert back to using their maiden name with their dealings with his Department; and if he will make a statement on the matter. [19232/07]

The person in question was granted permission to remain in the State on 6 April, 2005 under the revised arrangements for parents of Irish children born prior to 1st January, 2005, commonly referred to as the IBC/05 scheme. This permission to remain was issued in the former name. An application for renewal of this permission to remain was received by my Department in March 2007. This permission to remain was renewed in April 2007 and was also issued in the former name of the person concerned. This permission to remain is valid until 6 April 2010.
There is no legal impediment to the person in question reverting to their maiden name. However, the person in question will have to submit full documentary evidence (original Birth Certificate, Marriage Certificate and Divorce papers) to confirm entitlement to the use of this name.
