Question 399: To ask the Tánaiste and Minister for Justice, Equality and Law Reform his views on withdrawing the State's appeal in relation to a judicial review decision in relation to a person (details supplied) in County Limerick who has applied for leave to remain in the State; and if he will make a statement on the matter. This applicant applied for asylum on 28th April, 2005. His application was refused and a Deportation Order was made on 21st July, 2005. The applicant instituted Judicial Review proceedings on 29th September, 2005 challenging the Deportation Order made in respect of him and accordingly, as the matter is sub judice, I do not propose to comment further.
