Question 418: To ask the Minister for Justice, Equality and Law Reform when a decision will be made regarding an application by persons (details supplied) to remain here as they are the parents of an Irish born child; and if he will make a statement on the matter. [19309/06]

The persons in question applied for permission to remain in Ireland on the basis of being parents of an Irish child, born before 1 January 2005, in accordance with the revised arrangements announced by me on 15 January 2005. One of the requirements for permission to remain in the State under the revised arrangements is that parents must be continuously resident in the State since the birth of their Irish born child. The child in question was born on 24 September 2004, but neither of the parents has submitted evidence of continuous residence in the State since that date. Accordingly their applications did not meet the requirements of the revised arrangements and were refused.

The immigration status of the first named person will be reviewed and she will then have an opportunity to make representations as to her continued presence in the State. The second named person has already been afforded an opportunity to make representations as to why he should remain in the State. When representations are received I will further consider his position in the State.
