Question 264: To ask the Minister for Education and Science the recourse which is open to a person who is of the opinion that they were more qualified for a post (details supplied) than the person who was appointed to the post; if there is an appeals process that can be accessed in a situation such as this; and if she will make a statement on the matter. Appointments to posts of the kind indicated are a matter for the vocational education committee as the employer. My Department prescribes qualifications for appointment but does not sanction individual appointments. It is open to interested parties who are dissatisfied with such an appointment to present a complaint to the VEC. If no satisfaction is obtained, the matter may be brought to my attention for investigation. Appointments made by VECs are covered by the Vocational Education Acts.
The case in question has been the subject of correspondence between the VEC, the unsuccessful applicants and my Department. I am satisfied the appointment is in conformity with the relevant regulations.
