Question 490: To ask the Minister for Justice, Equality and Law Reform if he will make a statement on the allegations made by a person (details supplied) in County Waterford in regard to criminal charges taken against them, and specifically their claim that a member of the Garda corruptly initiated and proceeded with those charges; if he will agree to hold a full investigation into this person's allegations. I am informed by the Garda authorities that the person referred to has been prosecuted for a number of road traffic offences since 1989. As a result of failure to pay fines imposed for a parking offence in 1990, a warrant was issued in September 1991. The warrant was cancelled in December 1991, when it was believed that the person referred to was not resident in the country.

I am further informed that in 1996 as a result of non-payment of a further fine imposed for road traffic offences the person referred to was lodged in Cork Prison. In 2001, summonses were issued in respect of public order offences. The person was fined at Kilmacthomas District Court. The Garda authorities state that these matters have been examined by local Garda management and there is no evidence to support the allegations made.
