Question 135: To ask the Minister for Justice, Equality and Law Reform if he has received an appeal against the refusal of a visa for a person (details supplied) in view of the fact that this person's spouse is working here for over four years; if he will take steps to ensure a visa is granted in this case; and if he will make a statement on the matter. The appeal against the decision of the visa application referred to by the Deputy was received by my Department on 19 September 2005. In the case of all non-EEA workers seeking to be joined by their family members, they must be in a position to support the family members in question without the need for those family members to have recourse to public funds or paid employment.

Unfortunately, the level of income in this case did not demonstrate that the person is in a position to support their spouse without recourse to public funds. My Department is, therefore, not in a position to grant the visa at this time. However, in the circumstances of this case, I am prepared to consider any fresh representations which may be made by the persons concerned outlining reasons they feel their particular case should be regarded as an exceptional circumstance which would warrant the approval of the visas in question.
