Question 336: To ask the Tánaiste and Minister for Health and Children if a person who is occupying a bed in a private nursing home which has been contracted by the Health Service Executive is obliged to sign a separate contract of care with the nursing home in respect of the care that will be provided; if the Health Service Executive has set stipulations in relation to such a contract of care; if the new charges which are applied in respect of a contracted bed are being collected on an agency basis by the nursing home; and the authority which is granted to the nursing home in respect of the recovery of these charges when they are acting as agents on behalf of the Health Service Executive. The Deputy's question relates to the management and delivery of health and personal social services, which are the responsibility of the Health Service Executive under the Health Act 2004. Accordingly, the Department has requested the parliamentary affairs division of the executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.
