General Scheme of the Garda Síochána (Recording Devices) (Amendment) Bill: Discussion
Dr. Daragh Murray:
I echo Dr. Lynch's comments. Ireland has an opportunity to establish best practice in this area.
In the UK, the answer is quite simple. There is no explicit legal basis for the use of facial recognition so the legal framework is based on a combination of the common law policing powers and then police forces' own policy documentation. Linked to that is the fact that there is no judicial oversight of the use of facial recognition. That is the way it is at the moment. That would be liable to legal challenge in the future and I cannot see it holding but as it stands, there is no explicit legal basis or judicial oversight.
