General Scheme of the Garda Síochána (Recording Devices) (Amendment) Bill: Discussion
Professor David Kaye:
I was going to say that Dr. Lynch has said it better than I will say. There is very limited state practice on this. I echo the point that this is an opportunity to place this practice under rule of law. This is a subject of very serious controversy, particularly in the US. Because issues like access to facial recognition technology will be dealt with state-by-state or even municipality-by-municipality, for some time, some jurisdictions are banning the availability of it altogether. It is worth keeping in mind that this is a very dynamic and novel situation and a subject of very significant controversy and significant abuse because of the lack of rule of law guard rails in many jurisdictions around the world.
