General Scheme of the Online Safety and Media Regulation Bill: Discussion (Resumed)

Mr. Toby Dagg:

I will transition to discussing the arrangements under the new Act.

We have found over the life of the cyberbullying scheme that harm is happening on social media, on relevant electronic services like instant messaging and gaming services and on websites. The legislation as it is written now under the Enhancing Online Safety Act does not cater for websites within the cyberbullying scheme. They need to be social media or relevant electronic services. The online safety Act creates a degree of uniformity across all our regulatory schemes, so they focus on the harms that occur across platforms. What will be brought into scope through the reforms are websites, other designated Internet services and anything that can be reached by an Internet connection. That is where some of the more serious, cross-platform cyberbullying is happening. As a result, the social media-focused tiered scheme will be abolished in favour of that broader approach.
