General Scheme of Data Protection Bill 2017: Discussion

9:30 am

Mr. Seamus Carroll:

There is the right under current law to seek erasure, but that right is being beefed up in the regulation. It will be a matter for individuals to exercise their right against the data controller. In the event that the right to seek erasure is refused, a complaint will be brought to the Data Protection Commission which will will investigate. One of its powers will be to order the controller to comply with a request from a data subject. In the event of that not happening, various corrective powers are provided, including, for example, the imposition of an administration fine.
