Regulation (EC) 1008/2008, otherwise known as the EU's Air Services Regulation, lays down the common rules for the operation of air transport services within the European Union.
Article 19 of the Regulation, contained in the Chapter that deals with access to routes, sets out the rules governing traffic distribution between airports and the exercise of traffic rights. There are specific conditions to be met by any Member State wishing to utilise the provision concerning traffic distribution between multiple airports. These include, but are not limited to, the airports in question serving the same city or conurbation and a direct connection making it possible to travel between the airports within 90 minutes.
There are a limited number of cities within the EU that meet the specified criteria. In addition to meeting the criteria, any intended application of this Article by a Member State is subject to review and approval by the European Commission before it can come into force.
