To ask the Minister for Employment Affairs and Social Protection the number and value of contracts that underwent post-award variations; the net value change as a percentage of original awards, by CPV/category; and the three most common drivers of variation identified, for 2022–2024. Contracts awarded by my Department are operated in accordance with the provision of national legislation, EU Directives and the Office of Government Procurement (OGP) guidelines. The Department uses in so far as is possible the Central Arrangements established by the OGP for goods and services and the contract templates provided by the OGP, which have been signed off by the Chief State Solicitor's Office (CSSO).
Calls for Tender published by the Department for Contract and Frameworks contain a clause that prices may be increased or decreased only on the first extension of the Contract and on subsequent anniversaries of the Effective Date thereafter, and then only by the percentage by which the Consumer Price Index (CPI) has increased or decreased in the edition of the Index published by the Consumer Price Index most recently prior to that anniversary.
The Contract and Framework templates signed off by the CSSO contain a change request clause but they or post-award variations have not been invoked in contracts in place for the period in question.
