I can advise the Deputy that following full consideration by an immigration Officer, the EU Treaty Rights application referred to was refused. The reasons for this decision were set out in the refusal letter sent to the applicant and the applicants legal representative on 30 June and 01 July 2025. An appeal of this decision was received on 26 July 2025, and this continues to be examined.
I can further advise the Deputy that the person cited is also the subject of a deportation order. A deportation order is a legal order to leave the State. Any person who has been ordered to leave the State and fails to do so is committing a criminal offence, and can be arrested without warrant if they come into contact with An Garda Síochána.
A request to have this deportation order revoked, pursuant to the provisions of Section 3(11) of the Immigration Act 1999 (as amended), is currently under consideration by my Department’s Repatriation Division. This request will be considered as soon as it is possible to do so. Following consideration of this request, the existing deportation order will be either ‘affirmed’ or ‘revoked’. Once such a decision has been made, this will be notified to the applicant in writing.
