452. To ask the Minister for Finance the ‘market value’ homeowners affected by defective concrete blocks are expected to declare for local property tax purposes, given that many of these homes are structurally unsound, unmortgageable, and effectively unsellable in some cases having a negative market value due to the cost of demolition and reconstruction far exceeding any residual land value; and the specific guidance the Revenue Commissioners have issued to such homeowners to ensure they are not unfairly taxed on properties that have, in economic terms, no marketable value; and if he will make a statement on the matter. Local property tax (LPT) is a self-assessed tax. It is a matter for every property owner to calculate the tax due on their property based on their assessment of its market value.

Properties constructed using defective concrete blocks may be exempt from LPT for a period of 6 years, subject to meeting one of the following conditions:

1. The property is eligible for the Defective Concrete Blocks Grant Scheme administered by Clare, Limerick, Sligo, Mayo and Donegal County Councils, or:

2. An insurance company, or the builder who built the property, has:

  • carried out the necessary remediation work, or
  • has provided sufficient funds to carry out this work to the required standard.

Where an exemption does not apply, it is acknowledged that the existence of defects in the construction of a property can have a negative effect on its market value. Accordingly, where property owners have experienced a significant loss in their property’s value for this reason, this can be reflected when they select their valuation band. Taxpayers will be able to identify the appropriate band when filing their LPT return, which must be submitted by 7 November 2025.
