To ask the Minister for Enterprise, Trade and Employment if his Department has had any contact from the Department of Education and Youth regarding the interpretation of employment permit rules potentially excluding post-primary teachers, as a full time post primary contract is 22 hours; and if he will make a statement on the matter. The role of post primary teacher is eligible for the General Employment Permit and applications are subject to the relevant criteria set out in the employment permits legislation. To qualify for a General Employment Permits, the following key criteria must be met:

  • Minimum weekly working hours: The role must offer at least 20 hours per week.
  • Minimum annual remuneration: The salary must be at least €34,000 per annum,
If employment in an eligible occupation offers fewer than 39 hours per week, an application may still be considered once the total annual salary still achieves the €34,000 minimum threshold and the minimum 20 hours or more per week. Once these conditions are met the application may be considered for the grant of a General Employment Permit.

Officials of my department inform me that no queries have been received from the Department of Education and Youth regarding employment permits criteria that excludes post primary teachers and minimum contract hours for an employment permit.
