To ask the Minister for Housing, Planning, and Local Government if exemptions exist for local authority planning development fees; if medically adapted extensions to properties are included in exemptions; the process to apply for exemptions; and if he will make a statement on the matter. Under the Planning and Development Act 2000, as amended (Act of 2000), all development, unless specifically exempted under the Act or associated Regulations, requires planning permission. Any development which is classed as exempted development does not require planning permission and no fees are payable to the relevant planning authority.
Section 4 of the Act of 2000 and Schedule 2 of the Regulations of 2001 set out the various exemptions from the requirement to obtain planning permission. Any such exemptions are subject to compliance with any general restrictions on exemptions set out in the Act or the Regulations and to the specific conditions set out in each class of exempted development in Schedule 2 of the Regulations.
Class 1 of Part 1 of Schedule 2 of the Regulations of 2001 sets out the planning exemption provisions for house extensions subject to certain conditions and limitations. Where exemptions are available, they apply universally.
Where any individual is unsure if they can avail of any specific exemption such as for an extension to a house, section 5(1) of the Act of 2000, provides that “if any question arises as to what, in any particular case, is or is not development or is or is not exempted development within the meaning of the Act of 2000, any person may, on payment of the prescribed fee, request in writing from the relevant planning authority a declaration on that question, and that person shall provide to the planning authority any information necessary to enable the authority to make its decision on the matter.”
