236. To ask the Minister for Transport, Tourism and Sport the legal provisions designed to prevent the abuse of scrambler bikes, e-bikes or quads on public roads or public spaces; and if he will make a statement on the matter. [48540/25]

As Minister of State for International and Road Transport, Logistics, Rail and Ports, I wish to advise the Deputy that the Road Traffic and Roads Act 2023 addresses dangerous driving and the antisocial use of scramblers and quadbikes through three key measures.

  • Section 5(k) makes dangerous driving an offence in all locations, not just in public places.
  • Section 5(p) gives An Garda Síochána new powers to seize vehicles.
  • Section 11(b) allows the Minister for Transport to make regulations for the prohibition or restriction of certain classes of vehicle in specified areas.
A commencement order (SI 392/2023) has been signed into law, bringing Sections 5(k), 5(p), and 11(b) into effect, allowing An Garda Síochána to seize vehicles — including scramblers, quadbikes, and motorbikes — being driven dangerously in any location.

My Department is currently engaging with stakeholders to prepare regulations under Section 11(b). It is essential that these regulations appropriately target the relevant vehicles, locations, and jurisdictions.

The regulatory framework for the use of pedal cycles on public roads and in public places also applies to e-bikes. Accordingly, the same legal provisions are used for both pedal cycles and e-bikes.
