To ask the Minister for Housing, Planning, and Local Government if local authorities will grant planning permission to install a private EV charger in a public space such as for apartment buildings; if EV chargers for parking spaces will be added to the current list of planning exemptions; to provide clear guidance in regard what is and is not allowed in regard to the installation of EV chargers; and if he will make a statement on the matter. While the Planning and Development Act 2024 (Act of 2024) was enacted in October 2024, it is in the process of being commenced. The provisions of the Planning and Development Act 2000, as amended (Act of 2000), and associated Planning and Development Regulations 2001, as amended (Regulations of 2001) remain in force until the relevant sections of the Act of 2024 are commenced and the corresponding sections of the Act of 2000 are repealed.
Currently, EV charging points are exempt from planning under Class 29A and Class 29B of Part 1 of Schedule 2 of the Regulations of 2001. Class 29B specifically provides for charging hubs where car parking is available. It is open to the management company of an apartment building, or complex, to make use of planning exemptions should suitable space be available. Where housing is along a public road, a road opening licence under section 13 of the Roads Act 1993 as amended may be required and falls under the responsibility of the Minister for Transport. If housing is along a private road, the use of any exemption is a matter for the relevant landowner.
