422. To ask the Minister for Enterprise, Trade and Employment when a decision will be made on an employment permit appeal for a person (details supplied); and if he will make a statement on the matter. [48515/25]

The General Employment Permit application in question was refused on the basis that the requirements in relation to the Labour Market Needs Test were not fully met.

Specifically, the job advertisement was not placed with the Department of Social Protection/EURES for the required duration of 28 days within the 90-day period preceding the application. This is a mandatory requirement under the employment permit regulations. As the legislation does not provide for discretion in cases where the Labour Market Needs Test has not been correctly carried out, the application could not be approved.

The applicant was informed of their right to request a review of the refusal decision within 28 days of its issue. A review request was submitted on 9 September 2025 but was subsequently withdrawn on 10 September 2025.

The refusal to grant an employment permit does not preclude an applicant from submitting another application for an employment permit. Such an application should comply with all of the legislative requirements for the particular employment permit type.
