1666. To ask the Tánaiste and Minister for Justice and Equality to provide the details and addresses of all properties in the ownership of the Department that are absolved from paying commercial rates to the relevant local authority of the location that the property is in; to provide a similar list of properties for agencies or bodies under its remit that are also absolved from commercial rates, in tabular form; and if he will make a statement on the matter. Property directly occupied by any Department or Office of State is not rateable under the Valuation Act 2001, Part IV, Section 15: “Property, being a building or part of a building, land or a waterway or a harbour directly occupied by the State (including any land or building occupied by any Department or Office of State, the Defence Forces or the Garda Síochána or used as a prison or place of detention), shall not be rateable.”

I am informed by the agencies under the aegis of my Department that they are similarly exempt under the Act. Any non-payment of commercial rates to a local authority by my Department, or bodies under its aegis, is due to the statutory exemption referred to above rather than being absolved from paying rates to the relevant local authority.
