To ask the Tánaiste and Minister for Justice and Equality to provide details of the number of offences under s.2 and s.3 of the Non-Fatal Offences Against the Person Act 1997 and relevant Public Order Act 1994 provisions where the victim’s nationality was recorded as Indian, with monthly and Garda division breakdowns; and if he will make a statement on the matter. The Government is determined to stamp out hate-motivated crimes and to protect vulnerable communities. I condemn the recent attacks on members of the Indian community.

I am aware that An Garda Síochána takes crime against minority groups very seriously. Every suspected hate crime reported to An Garda Síochána is professionally investigated and victims supported during the criminal justice process. The recent victims are being supported by dedicated liaison officers, and all witnesses or victims of hate crimes should report these to An Garda Síochána.

The Central Statistics Office (CSO), as the national statistical agency, is responsible for the compilation and publication of all crime statistics.

The CSO produces these statistics using data recorded on An Garda Síochána’s PULSE system and makes regular releases in relation to various crime statistics. The most recent statistics were released on 2 July 2025, providing statistics for Recorded Crime for Quarter 1 2025.

Information in respect of criminal offences reported to Gardaí, can be found on the CSO website at the following link: www.cso.ie/en/statistics/crimeandjustice/recordedcrime/.

Data sets providing figures on recorded crime incidents by Garda Station/ Division, type of offence and year/ quarter can be found on the CSO website at the following link: www.cso.ie/en/releasesandpublications/ep/p-rc/recordedcrimeq12025/data/.

I am advised by the Garda authorities that where information on a person's nationality is known it is generally recorded as part of their PULSE record. I understand it is not the practice of the Central Statistics office to compile statistics on nationality or ethnicity.

To ask the Tánaiste and Minister for Justice and Equality the number of recorded hate related crimes and incidents flagged with bias motivation to race, ethnicity and nationality for the period 11 February 2025 to 11 August 2025; the subset where victim nationality was Indian; and the number of charges citing hate aggravation under the Criminal Justice (Hate Offences) Act 2024, indicating prosecutions initiated and any available court outcomes, with a division-level breakdown. The Garda Commissioner is responsible for the management and administration of Garda business, including the compilation and management of crime related statistics.

In relation to the specific information sought by the Deputy, I am advised by the Garda authorities that reporting on hate crime is provided on an annual basis through proactive publication. The latest publication is available here - www.garda.ie/en/information-centre/statistics/hate-crime-statistics.html.

I am further advised, that data on nationality and ethnicity is not widely collated on PULSE and is not considered suitable for publication.

The management of the courts, operational matters and logistical functions are the responsibility of the judiciary and Courts Service, which are independent in exercising their functions under the Courts Service Act 1998 and the Constitution.

The Courts Service has a dedicated email address for the provision of information to members of the Houses of the Oireachtas: oireachtasenquiries@courts.ie

To be of assistance, I requested the information sought by the Deputy. The Courts Service have advised that offence codes for offences contrary to the Criminal Justice (Hate Offences) Act 2024, went live on both Pulse and CCTS (the case management system used in the District Court) on 23 April, 2025. Where prosecutions were brought before the courts before this date, prosecutors would have used free-text for these offences, which are not reportable within the system.

Since the offence codes went live on 23 April 2025, there have been four prosecutions before the courts for offences contrary to the Criminal Justice (Hate Offences) Act 2024 as follows:

  • 3 prosecutions for the offence of “Threatening, abusive or insulting behaviour in public place aggravated by hatred” which is contrary to Section 6A of the Criminal Justice (Public Order) Act 1994, as inserted by Section 6(c) of the Criminal Justice (Hate Offences) Act 2024
  • 1 prosecution for the offence of “Assault causing harm aggravated by hatred” which is contrary to Section 3B of the Non-Fatal Offences Against the Person Act 1997, as inserted by Section 7(d) of the Criminal Justice (Hate Offences) Act 2024.
All four prosecutions are currently ongoing before the District Court, therefore, no outcomes are available at this time.

The Courts Service cannot provide information on the nationality of victims, as such details are not required to initiate a prosecution of these offences, consequently they are not included as part of the court record.

To ask the Tánaiste and Minister for Justice and Equality to provide comparative figures for the same offence categories and period (details supplied) for Irish nationals and to provide details of the five most frequently recorded non-Irish victim nationalities; to provide the data quality profile, that is rates of unknown or not recorded for nationality and ethnic/cultural background fields; the current recording guidance to members, and whether she will commit to quarterly publication of disaggregated statistics and to placing the underlying tables in the Oireachtas Library. Hate Crime statistics for 2025 will not be published until 2026.

An Garda Síochána does not consider PULSE data regarding nationality and ethnicity suitable for publication. This is in line with the position taken by the CSO in relation to such data.
