As the Deputy will appreciate, management of the courts and court records is the responsibility of the judiciary and Courts Service, which are independent in exercising their functions under the Court Service Act 1998 and given the separation of powers in the Constitution. To be of assistance, my officials have had enquires made of the Courts Service regarding the information sought.
Where cases are dismissed by the presiding judge under Section 26 of the Civil Liability and Courts Act 2004, the case is recorded as “struck out” or “dismissed”. The reasons for dismissal (Section 26) and any other consequent order or direction, such as a direction to notify An Garda Síochána and provide them with a transcript for their investigation as well as to prepare a file for the Director of Public Prosecutions would be recorded as freetext in the court order. However, the Courts Service have advised it is not possible to produce a report based on free text entries.
