The Protection of Employees (Employers' Insolvency) (Amendment) Bill 2025 was published on 23 May 2025.
This Bill will, inter alia, amend the Protection of Employees (Employers’ Insolvency) Act 1984 to expand access to the Insolvency Payments Scheme to protect employees of employers who cease trading without entering into liquidation, receivership or bankruptcy, and provide for the full transposition of Article 2(1) of Directive 2008/94/EC.
The Bill completed Second Stage in the Dáil on 27 May 2025.
The timeline for the enactment of the Bill is a matter for the Oireachtas, and the Bill is expected to resume progress during the Autumn session.
My officials and officials in the Department of Social Protection, which administers the Insolvency Payments Scheme on my behalf, are advancing the necessary preparations to ensure the new Deemed Insolvency process set out in the Bill can be operationalised as soon as is practicable when the Bill is enacted.
