Nitrates Usage

2180. To ask the Minister for Agriculture, Food and the Marine if he will seek clarity on the EU Commission's proposed changes to the derogation and its potential impact on Irish farmers; and if he will make a statement on the matter. [41680/25]

In June the European Commission wrote to Ireland clearly outlining the need for Ireland to provide clarity and assurances that assessments will be performed on the environmental effects of any potential new nitrates derogation including with regard to the Habitats Directive and ensuring non-deterioration of sites designated under that Directive.

Previously when preparing a new Nitrates Action Programme, and seeking an extension to its nitrates derogation, Ireland complied with the requirements of the Habitats Directive by performing one programme level national Appropriate Assessment. However the Commission's letter received last month is clear that a more detailed assessment is now required. It is also clear that if we fail to propose an acceptable approach in response to the Commission's request, we will not be granted a further nitrates derogation.

In determining a proposed pathway to legal compliance with evolving case law under the Habitats Directive, my officials continue to engage with contracted expertise in relation to that Directive as well as officials in the Department of Housing, Local Government and Heritage. Given the significance of this work it is important that we ensure every option is fully considered before we propose an approach to the European Commission. As part of that process, I and my officials will also continue to engage with stakeholders as we seek to develop and finalise that proposal.
