885. To ask the Minister for Enterprise, Trade and Employment if there is any current legislation governing the operation of nail salons, including qualifications and hygiene regulations; and if he will make a statement on the matter. [41139/25]

There is a suite of Occupational Safety and Health legislation, listed below, that is applicable to workplaces including nail salons.

  • Safety, Health and Welfare at Work Act, 2005 requires employers to provide a safe place of work. It provides the legal framework for managing workplace health and safety and sets out duties for both employers and employees.
  • Safety, Health and Welfare at Work (General Applications) Regulations 2007 to 2023 has requirements for the workplace, work equipment, first aid, manual handling, noise, electricity and the protection of sensitive risk groups.
  • Safety, Health and Welfare at Work (Biological Agents) Regulations, 2013 and 2020 outline the minimum requirements for the protection of workers from the health risks associated with biological agents in the workplace. This is supported by the Code of Practice on Biological Agents 2020- hsa.ie/eng/publications_and_forms/publications/biological_agents/cop_biological_agents_2020.pdf.
  • Safety, Health and Welfare at Work (Chemical Agents) Regulations Act, 2001-2021 require risk assessments of the chemical hazards, putting control measures in place and providing training on the hazards and controls.
  • Safety, Health and Welfare at Work (Carcinogens, Mutagens and Reprotoxic Substances) Regulations 2024 also requires risk assessments of the chemical hazards, putting control measures in place and providing training on the hazard controls.
  • Code of Practice Chemical Agents 2024 (Code of Practice for the Safety, Health, and Welfare at Work (Chemical Agents) Regulations (2001-2021) and the Safety, Health, and Welfare at Work (Carcinogens, Mutagens, and Reprotoxic Substances) Regulations (2024). www.hsa.ie/eng/publications_and_forms/publications/codes_of_practice/chemical_agents_code_of_practice_2024.html.

This information leaflet has been developed to provide practical advice to those working in the nail industry.

The Deputy may wish to consult with the Minister for Health with regard to public health and infection control, and the regulation and safe use of cosmetics and the Minister for Higher Education, Research, Innovation and Science as the Education and Training Boards fall under his remit.
