Under the European Union (Road Transport) (Working Conditions and Road Safety) Regulations 2017, both the Road Safety Authority (RSA) and An Garda Síochána (AGS) are empowered to take prosecutions over offences committed under the European Union Regulation (EC) No 561/2006 of the European Parliament and of the Council of 15 March 2006 on the harmonisation of certain social legislation relating to road transport. I understand that the RSA collates data relating to convictions under this legislation.
Given the RSA's role in this regard, I have referred the Deputy's question to the RSA for a more detailed response on this issue. Please contact my office if a reply is not received within ten days.
