127. To ask the Minister for Education and Skills the current status of a request (details supplied) to revoke the S1 form to allow them to revert as a new entrant; and if she will make a statement on the matter. [40150/25]

My department is not in a position to revoke the information provided by the person concerned on the S1 form. This form is used to provide details of previous service in the public sector. Under the provision of the Public Service Superannuation (Miscellaneous Provisions) Act 2004 a "new entrant", in general, refers to individuals who started working in a public service body on or after April 1, 2004, and had not previously served in any public service capacity before that date or had a break in service in excess of 26 weeks. This status is relevant for pension scheme membership and other terms of employment.

The person concerned is deemed to be a non-new entrant, as she had public sector service from 2003 without a break of 26 weeks. My department is not in a position to deviate from this piece of legislation or to ignore the information provided by the scheme member.
