753. To ask the Tánaiste and Minister for Justice and Equality if he will consider extending permission to work to young adults (aged 16 and over) who are residing in Ireland on Stamp 3 permissions, as the child of a parent who is on a Stamp 4 (critical skills) permission, as these young adults cannot take up employment, either full-time or temporary, whilst on a Stamp 3; and if he will make a statement on the matter. I can inform the Deputy that, under the Non-EEA Family Reunification Policy, a dependent child of a Critical Skills or General Employment Permit holder, between the age of 16 and 18, is issued with a stamp 3 immigration permission and cannot work or engage in any business, trade or profession without an employment permit. However, it is open to them, after residing in Ireland for at least 5 years, to apply for an independent Stamp 4 permission which entitles them to work without an employment permit.
The review of the Policy Document for Non-EEA Family Reunification, which was last amended in 2016, is examining a wide range of matters relating to for family reunification. My Department has consulted with a wide variety of stakeholders and changes to the regime of permissions for children (aged 16 to 18) of Critical Skills and General Employment Permit holders have been carefully considered. The expectation is that the review will be brought to a conclusion in the near future.
I can also advise that, with effect from 15 May 2024, the first part of the review was implemented in that eligible spouses and partners of General Employment Permit and Intra-Corporate Transfer Irish Employment Permit holders, who have applied for and been granted family reunification, in accordance with the Non-EEA Family Reunification Policy, are now registered on a Stamp 1G permission, rather than a Stamp 3. This will allow the holder to take up employment without the need to obtain a separate Employment Permit of their own.
