293. To ask the Minister for Agriculture, Food and the Marine if a review of a penalty imposed on a person (details supplied) can be authorised given that all non-compliant measures have been rectified since the last inspection; and if he will make a statement on the matter. [38372/25]

The herd owner in this matter was subject to a Local Authority Inspection, by Leitrim County Council, on 30th January 2025, following which a cross report was submitted to my Department. The result of this inspection was communicated by Formal Notice to the herd owner on 10th June 2025, by my Department’s local District Superintendent for Leitrim. The following non compliances were outlined in relation to Conditionality requirement SMR 2 Nitrates Regulations:
- Evidence of inadequate management of the storage facilities for livestock manure.
- Evidence of the applications of organic fertiliser or soiled water using an upward facing splash plate or sludge irrigator mounted on a tanker.
- Evidence of the applications of organic fertiliser or soiled water from a road or passageway.
- Evidence of the spreading of chemical fertiliser or organic fertiliser, including farmyard manure and soiled water, during the relevant prohibited period.
