To ask the Tánaiste and Minister for Justice and Equality whether his Department has had any engagement with the European Commission regarding the adequacy decision granted to the State of Israel under Article 45 of Regulation 2016/679; and if he will make a statement on the matter. On 15 January 2024 the European Commission announced it had concluded its review of 11 existing Adequacy Decisions.

In its published report, the Commission found that personal data transferred from the European Union to Andorra, Argentina, Canada, Faroe Islands, Guernsey, the Isle of Man, Israel, Jersey, New Zealand, Switzerland and Uruguay, continued to benefit from adequate data protection safeguards. Therefore, the adequacy decisions adopted for these 11 countries and territories remain in place and data can continue to flow freely to these jurisdictions. The Decision in respect of Israel is in place since 31 January 2011.

My Department had no direct engagement with the European Commission in relation to the review of the Adequacy Decisions in respect of any of the 11 jurisdictions concerned.
