To ask the Minister for Public Expenditure and Reform if the Chief State Solicitor’s Office or Kildare County Council provided the OPW with confirmation that they could continue to pursue a renewal of the lease at a location (details supplied); if so, on what date was that provided; and if he will make a statement on the matter. To ask the Minister for Public Expenditure and Reform the extent to which the OPW sought to establish what portion of a road was owned by Kildare County Council (details supplied); whether that portion of the road could be secured, and at what cost; if discussions took place re same; the actions taken thereafter; and if he will make a statement on the matter. I propose to take Questions Nos. 26 and 27 together.
The initial portion of the road in question is in the ownership, and under the management, of the local authority. As this portion of road is in the charge of the local authority, the OPW can use this portion of road as an ordinary road user without the need for a formal agreement.
The road in question has never been leased by the OPW or Kildare County Council so the issue of a lease renewal does not arise.
