94. To ask the Minister for Housing, Planning, and Local Government whether he will legislate to ensure that there is an obligation on landlords and letting agents to inform tenants of any overpayments they may have made. [38047/25]

The Residential Tenancies Board (RTB) was established as a quasi-judicial independent statutory body under the Residential Tenancies Acts 2004 to 2024, to operate a national tenancy registration system and to facilitate the resolution of disputes between landlords and tenants.

Where there is a question regarding the appropriate level of rent paid, a dispute may be referred to the RTB under Part 6 of the Acts - please see www.rtb.ie for information on the RTB's dispute resolution service.

When landlords, tenants and third parties bring disputes to the RTB, they receive a legally binding Determination Order, which may direct the payment of damages of up to €20,000, and if not complied with, can be enforced through the District Court.

My Department and the RTB keep the operation of the Residential Tenancies Act and the residential rental sector under review with a view making any necessary legal change.
