To ask the Minister for Culture, Heritage and the Gaeltacht regarding the sale of a property (details supplied) the price received for the sale of this asset and the terms and conditions of the contract have yet to be publicly disclosed; his views on whether the details of the sale should still be a matter of confidentiality; and if he will make a statement on the matter. My Department does not hold a copy of the sales agreement to which the Deputy refers.
On the matter of confidentiality, the Deputy may be aware that the Office of the Information Commissioner (Reference OIC-121881-Y9W8V9) upheld a decision by Údarás na Gaeltachta to refuse access to the contract under section 35(1)(b) of the Freedom of Information Act on the grounds that the release of the record constituted a breach of the duty of confidentiality provided for by the contract provision.
